Warranty

PRICES EFFECTIVE Jan. 31, 2020 THROUGH Jan. 30, 2021.

Stackhouse reserves the right to change prices without notice in the event of extreme conditions.

Disclaimer: Every attempt is made to ensure the highest degree of protection and performance from all Stackhouse Athletic Equipment, Inc. products. However, we cannot guarantee freedom from injury. The user assumes all risk of injury relative to its use. Stackhouse assumes no liability for improper use, maintenance, or assembly negligence. Notwithstanding anything to the contrary contained herein, Stackhouse shall have no liability, whether arising in contract, tort, or otherwise, for any loss of profit or use, property damage, or any indirect, special, incidental or consequential charges. Every product is sold with this condition, and representatives of Stackhouse may not waive or change it. The purchaser hereby agrees to indemnify and hold Stackhouse harmless from any claims or damages arising out of the use of the products by third parties. This provision includes, but is not limited to, purchaser's agreement that it will, in the event a claim is made, stand in the place of Stackhouse in investigating, responding to and defending against the claim and will pay all damages, costs, and attorney fees associated with defending against the claim.

Warranty: Stackhouse warranties all products against material and manufacturing defects up to 1 year from date of purchase. Products found, in the sole discretion of Stackhouse, to be misused, abused, or improperly maintained will not be guaranteed. Refund, repair or replacement shall be purchaser's sole remedy for any and all damage caused by, arising out of, or relating to any product purchased, including but not limited to any claim for breach of any warranty, express or implied, with respect to any product. Stackhouse reserves the right to change these terms at any time, without prior written notice to purchaser.

Freight policy: All products drop shipped from Stackhouse Athletic will be F.O.B. Salem, OR 97303 unless otherwise arranged with dealer. Risk of loss passes to purchaser upon delivery of product by Stackhouse to a carrier. Inspect all shipments for freight damage when received. Freight damage claims must be filed within 5 days of receipt, at the receiving end.
